| Pre-Game Requirements | Eligible Entrants will be required to show their ID to the Promoter or its agents prior to participating in the Game. | Game details | The Kicking Station will be set and the Target will be placed in preparation for the Game. The objective of the Game is to kick a supplied rugby league ball from the Kicking Station into the Target. Each Game will be run in the following manner: 1. before the Game, Eligible Entrants will be invited to the Kicking Station; 2. the Eligible Entrant will be instructed to take their kick, in the order dictated by the Promoter or its agents; and 3. the Eligible Entrant will be given one attempt at kicking the ball from the Kicking Station into the Target. Subject to the Further Information and Verification Requirements, if an Eligible Entrant kicks the rugby league ball into the Target and the rugby league ball remains in the Target, then their kick will be deemed a “Successful Kick”. |
| Prize | Any Eligible Entrant who completes a Successful Kick, will win a share in the Prize. If an Eligible Entrant does not complete a Successful Kick, they will not win a Prize or share in the Prize. A maximum of 10 Successful Kicks will be allowed, if 10 Successful Kicks occur the Game will end. The Prize will be provided to Eligible Entrants on the day of the Game. |
| Further Information and Verification Requirements | For a kick to be deemed a Successful Kick, the following must apply: • the rugby league ball must be kicked by the Eligible Entrant from the Kicking Station only and not moved closer or further from the Target or tampered with in any way before the kick is made; • an Eligible Entrant is not allowed to have any practice kicks or touch the balls before instructed; • the ball must be kicked by the Eligible Entrant's foot and enter the Target opening and remain within the Target opening. For the avoidance of doubt, a ball which bounces off the ground before entering the Target will be deemed a Successful Kick. Each Eligible Entrant's performance in the Game will be reviewed by an independent scrutineer, and the Prize will only be awarded when there is no reasonable doubt that their kick in the Game was a Successful Kick in accordance with these Terms. Further, each Eligible Entrant’s participation in the Game may be recorded by the Promoter and/or its third-party providers in one continuous, unbroken video recording (clearly showing the kick being taken and the trajectory of the ball). |
| Testimonial, Release and Advertising Material | Participation in the Game constitutes each Eligible Entrant’s consent to the Promoter’s use of the Eligible Entrant’s name and postcode for the purposes of any announcements or administration set out in these Terms and Conditions. Each Eligible Entrant acknowledges that they may be interviewed by the Promoter and/or its commentators, or any other related third-party organisation. The interview content may be used by the interviewing organisations, the Promoter on any form of media including, any social 3478-5182-8552, v. 4 media platforms. By participating in the Game, each Eligible Entrant consents to use of their image, likeness and statements made in interviews by the Promoter and each Eligible Entrant grants to the Promoter a non-exclusive, worldwide license to use, reproduce, modify, adapt, publish, transmit via the internet, and display footage (including the video of the kick captured by the Promoter) of their entry into the Game in any media whatsoever without further payment or consideration. Each Eligible Entrant further agrees to participate in any such reasonable media or publicity request following a Successful Kick as the Promoter may request. |

Terms and Conditions
1. By entering in this Promotion, Eligible Entrants acknowledge that they have read, understood and agree to these Terms and Conditions. The Competition Details form part of these Terms and Conditions.
Entries
2. An Entry must not include: any content that contravenes any law, infringes the rights of any person or is obscene, offensive, potentially defamatory, discriminatory, indecent or otherwise objectionable or inappropriate (which includes, without limitation, any content involving nudity, intoxication, malice, excessive violence or swearing).
3. The Promoter reserves the right to verify, or to require the Eligible Entrant to verify, that the Entry is the entrant’s own information, which may include personal information. If an Entry cannot be verified to the Promoter’s satisfaction, it may be deemed invalid.
4. Incomplete and indecipherable Entries and any Entry which has incorrectly entered personal information or contact details may be deemed an invalid Entry. No responsibility is accepted by the Promoter for late, lost, misdirected, ineligible or illegible/inaudible entries (including lost, stolen, forged, defaced or damaged proof of entry or things required by the Verification Requirements).
5. In the event of a dispute, all Entries will be deemed to have been submitted by the person whose name and contact information is reflected in the Entry submitted through the Humanitix site, as determined by the Promoter in its sole discretion.
6. The use of any automated entry software or any other robotic, programmed, script, macro or other automated entries that allows an Eligible Entrant to automatically enter the Promotion repeatedly is prohibited and will render Entries submitted using such means as invalid.
7. Entries must be received by the Promoter and will be deemed to have been received at the time of receipt by the Promoter. Online and other electronic entries are deemed to have been received at the time of receipt into the Promotion database and not at the time of transmission by the Eligible Entrant. 3478-5182-8552, v. 4
8. Any costs associated with accessing the Promotion website and the Game are the Eligible Entrant’s responsibility and are dependent on the internet service provider used. Eligible Entrants must submit their Entries and/or claims manually using an internet browser.
Promoter’s Rights
9. The Promoter’s decision in relation to any aspect of these Term and Conditions and the Promotion is final and binding on every person who enters. No correspondence will be entered into.
10. The Promoter may, in its sole discretion, declare any or all Entries made by an Eligible Entrant invalid, and/or prohibit further participation by an Eligible Entrant in this Promotion or a Prize if the entrant:
a. disrupts, annoys, abuses, threatens, harasses or attempts to do any of these things to the Promoter, another entrant or potential entrant of, or anyone else associated with, this Promotion;
b. submits an Entry that is not in accordance with these Terms and Conditions or who tampers with the entry process; or
c. engages in conduct in relation to this Promotion which is misleading, deceptive, fraudulent or damaging to the Promoter’s goodwill or reputation.
11. The Promoter may, acting reasonably and in its absolute discretion, edit, modify, delete, remove or take-down any part of an Eligible Entrant’s Entry.
12. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. If there is a dispute as to the identity of an Eligible Entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the Eligible Entrant.
13. All Eligible Entrants acknowledge that the Promoter can rely on these Terms and Conditions even if the Promoter only learns of a person’s ineligibility after the Promoter has awarded a Prize to the ineligible person. Return of the Prize or payment of its equivalent value to the Promoter may be required by the Promoter if this occurs.
14. Each Eligible Entrant is responsible for ensuring their familiarity with these Terms and Conditions at the time of participation. The Promoter’s decision not to enforce a specific restriction (whether communicated to an Eligible Entrant or not) does not constitute a waiver of that restriction or of these Terms and Conditions generally.
15. CAUTION: Any attempt to deliberately undermine the legitimate operation of this Promotion may be a violation of criminal and civil laws and should such an attempt be made, whether successful or not, the Promoter reserves the right to refer the matter to law enforcement authorities and/or to seek damages or such other civil remedies as the Promoter may determine from time to time to the fullest extent permitted by law.
Prizes
16. All Prizes will be provided to the Eligible Entrant on the day of the Game. 3478-5182-8552, v. 4
17. If there is no Successful Kick in the Game, the Prize is void and is not transferable or redeemable for any other prize or future event at the discretion of the Promoter.
Limitation of Liability
18. The Promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, communication network, computer equipment, software, technical problems or traffic congestion on the Internet or at any web site, or any combination thereof, including any error, omission, alteration, tampering, deletion, theft, destruction, transmission interruption, communications failure or otherwise, injury or damage to entries or to participants’ or any other person’s computer related to or resulting from participation in or down-loading any materials in this Promotion. If the Promotion is not capable of being conducted due to circumstances beyond the Promoter’s control, including due to any technical or communications problems or the cancellation of a Penrith Panthers game or games, the Promoter reserves the right to amend, suspend or cancel the competition subject to approval from any relevant authority.
19. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following:
a. any technical difficulties or equipment malfunction (whether or not under the Promoter’s control);
b. any theft, unauthorised access or third party interference;
c. any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;
d. cancellation of a Game due to circumstances outside the Promoter’s control;
e. any tax liability incurred by a winner or entrant; or
f. use of the Prize.
20. To the extent permitted by law, the Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, illness or death which is suffered or sustained (whether or not arising from any person’s negligence) in connection with the Game, entering the Promotion or accepting or using any Prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law). Nothing in these conditions restricts, excludes or modifies or purports to restrict, exclude or modify any statutory consumer rights under any applicable law including the Competition and Consumer Act 2010 (Cth).
21. Each Eligible Entrant agrees and acknowledges the risks associated with participating in the Promotion and the Game. Each Eligible Entrant also acknowledges and agrees that they 3478-5182-8552, v. 4 understand the indemnity provided by them in these Terms and Conditions and the limitation of liability for the Promoter in participating in the Promotion and the Game.
22. Each Eligible Entrant is liable for, and indemnifies the Promoter and other related respective parties and any respective officers, employees, contractors and agents (Indemnified Parties), from and against any loss or damage (including legal costs) however caused, suffered or incurred by the Indemnified Parties in connection with these Terms and Conditions, the Promotion, the acceptance or use of the Prize, the Game or any act or omission on the Eligible Entrants behalf.
Privacy / Marketing
23. The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties required for the provision of the Prize. Entry is conditional on providing this information. The Promoter may disclose the information for those purposes to its related bodies corporate and contractors. If Eligible Entrants do not provide the information requested they will not be able to enter the Promotion.
24. The Promoter is bound by the Australian Privacy Principles contained in the Privacy Act 1988 (Cth). To request access to, or to update, personal information the Promoter holds about them, entrants can contact the office of the Promoter.
General
25. The Promoter may communicate or advertise this Promotion using Facebook, Instagram or another social media platform. However, the Promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook, Instagram or any other social media platform. Entrants are providing their information to the Promoter and not to social media platforms. Each Eligible Entrant completely releases Facebook and Instagram from any and all liability in connection with this Promotion.
26. The Promoter and each of their related bodies corporate, officers, employees, agents and licensees are not liable to the Eligible Entrants for any tax implications arising out of the Prizes or the Promotion. The Eligible Entrants should obtain independent financial advice on tax implications that may arise as a result of accepting the Prize.
27. Except where prohibited by law, the Eligible Entrant agrees that any and all disputes, claims and causes of action arising out of, or connected with, the Promotion or any Prize awarded will be resolved individually.
28. Except where prohibited by law, all issues and questions concerning the construction, validity, interpretation and enforceability of these Terms and Conditions will be governed by, and construed in accordance with, the laws of New South Wales, Australia. All participants consent to the jurisdiction of the courts of New South Wales, Australia.
